1. Acceptance of Terms

By using the mobile application BuddyArt ("App"), you agree to be bound by these Terms of Service. If you do not accept these terms, do not use the App.

2. License to Use

BuddyArt grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal and non-commercial purposes. You may not reproduce, distribute, transmit, display, perform, publish, or license any part of the App.

3. Account Registration

To access certain features of the App, you may need to create an account. You are responsible for:

  • Keeping your password confidential
  • Accepting responsibility for all activities that occur under your account
  • Notifying us immediately of any unauthorized access to your account
  • Providing accurate, complete, and current information during registration

4. User-Generated Content

When you upload photos, comments, or other content to the App, you grant BuddyArt the non-exclusive right to use, copy, modify, and display such content. You are responsible for the content you upload and warrant that you have all necessary rights to do so.

The content you upload must not:

  • Violate the privacy, intellectual property rights, or other rights of anyone
  • Contain offensive, defamatory, abusive, or illegal material
  • Contain spam, viruses, or any other malware
  • Violate any applicable law or regulation

5. Prohibited Use

You may not:

  • Use the App for illegal purposes or in violation of applicable laws
  • Compromise the security of the App or servers or networks connected to it
  • Discriminate or harass other people
  • Attempt unauthorized access to services, accounts, or network systems
  • Collect or track personal information of other users without consent
  • Use the App to send unsolicited advertising or spam
  • Use software, bots, or scripts to access the App

6. App Availability

The App is provided "as is" and "as available". BuddyArt does not warrant that the App will always be available, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue the App at any time.

7. Disclaimer of Warranties

To the maximum extent permitted by law, BuddyArt is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the App, including loss of profits, loss of data, or loss of opportunity.

8. Limitation of Liability

BuddyArt's total liability for any claim arising from your use of the App shall not exceed the amount paid by you, if any.

9. Indemnification

You agree to indemnify, defend, and hold harmless BuddyArt, its owners, officers, employees, and agents from any claim, damage, loss, liability, and expense (including legal fees) arising from your breach of these Terms or your use of the App.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Modifications will be effective immediately upon posting. Your continued use of the App after modifications constitutes your acceptance of the new terms.

11. Governing Law

These Terms of Service are governed by the laws of the Italian Republic. Any disputes arising from these terms will be subject to the exclusive jurisdiction of Italian courts.
